The CRIMECAST® crime vulnerability assessment is based on US, Canadian and UK census data and other public records in the geographic area under review. Although these census data and other public records are considered highly reliable, CAP Index, Inc. is not able to vouch for their completeness or accuracy. Nevertheless, our statistical analysis as expressed in Reports, Maps, loss experience validations or other services must assume that these data, as recorded and compiled by the various governmental agencies and other sources, are in fact complete and accurate. CAP Index, Inc.’s conclusions, reflect only probabilities based upon statistical analysis of criminal activity over a period of time, not certainties.
CRIMECAST® crime vulnerability assessments are Reports and/or Maps that have been generated for multiple sites using latitude/longitude identifications. To the extent you have provided CAP Index, Inc. with those latitude/longitude identifications, CAP Index, Inc. has not independently verified the accuracy of the site identifications. CAP Index, Inc. will provide Reports and Maps based on the actual latitude/longitude identified by you, and thus the accuracy of those Reports and Maps will depend on the accuracy of the data provided by you.
CAP Index, Inc. may have provided you with latitude/longitude site identifications as a part of its address Geocoding service, either in conjunction with a CRIMECAST® order, or as a separate service. Address Geocoding provided by CAP Index, Inc. is based on physical addresses provided by you. Once again, CAP Index, Inc. does not independently verify the accuracy of those addresses, and thus the accuracy of the resulting CAP Index, Inc. products or services will depend on the accuracy of the data provided by you.
CAP Index, Inc. warrants that its products and services conform to the foregoing descriptions and that, subject to the limitations set forth, all reasonable efforts have been made to ensure that the data or analyses provided to you are accurate and useful.
EXCEPT AS SET FORTH IN THE PRECEDING PARAGRAPHS, CAP INDEX, INC. MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AND EXPRESSLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY AND ANY WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE.
TO THE FULLEST EXTENT PERMITTED BY LAW, CAP INDEX, INC. LIMITS OR DISCLAIMS LIABILITY RELATING TO THE PREPARATION, SALE AND USE OF THE PRODUCTS OR SERVICES AND TO ALL OTHER TRANSACTIONS AND MATTERS CONTEMPLATED BY OR ARISING FROM THIS PURCHASE ORDER, AS FOLLOWS:
1. FOR DIRECT DAMAGES, CAP INDEX, INC’S LIABILITY IS LIMITED TO AN AMOUNT EQUAL TO TWICE THE COST OF THE PRODUCTS PURCHASED OR SERVICES PROVIDED UNDER THIS PURCHASE ORDER OR $5,000, WHICHEVER IS GREATER.
2. CAP INDEX, INC. DISCLAIMS LIABILITY FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSS OF USE, REVENUES OR PROFIT), WHETHER SUCH CLAIM ALLEGES BREACH OF CONTRACT, TORTIOUS CONDUCT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE) OR ANY OTHER THEORY OF LIABILITY.

USE OF THE PRODUCTS OR SERVICES
Any products, services and all other material delivered by CAP Index, Inc. to you under your Purchase Order are furnished to you on a non-exclusive basis, solely for your own use and with the express understanding and agreement that, except as otherwise required by legal process, none of the information contained therein will be published, disclosed, or conveyed (directly or indirectly) by you to any person other than your partners, employees, agents or representatives or, if you are a consultant, a single client, on a need-to-know basis. You are not authorized to resell any products or material delivered to you by CAP Index, Inc.
You agree not to modify, decompile, disassemble, decrypt, extract, or otherwise reverse engineer any Cap Index, Inc. product, or any part thereof, for any reason.
